How to know if a free download is legal?

There's an old game I want to download for free, but how can I find out for sure if it's legal?

If you own the game, say it’s a NES game and you have the game but the console is broken, it’s perfectly legal to download that game.
If the game is an internet game that was created to be free, it’s legal.
Other than that though, it’s illegal.
